The Department of Private Law at the College of Law at Al-Qadisiyah University held a discussion session entitled (The basis of justice in settling disputes arising from investment relations), in which Assistant Professor Dr. Ammar Habib Al-Madani lectured. The session aimed to shed light on the determinants of settling investment disputes by reviewing the most important legislative developments at the level of international institutions and national legislation of comparative countries, with reference to the legal and economic foundations on which they were built, in which the public interest of the countries concerned was taken into account, represented by enhancing their development activity by attracting investment and encouraging investors to work in a legal environment capable of protecting their rights and ensuring the continuity of their investment projects. The session concluded that the private investment sector is an essential part of the developmental structure of countries, and therefore, caring for and guaranteeing the rights of investors actually represents a real protection and service to the public interest, because investment activity in countries that adopt a market economy (including Iraq) represents the main tool for achieving the public interest of societies, and therefore legal and judicial dealings with the private sector should be in accordance with the public interest regardless of the level of private benefit that these projects achieve for their owners. The seminar recommended that the systems and mechanisms for settling investment disputes in Iraq be amended in line with international developments in this field and in careful coordination with the comparative legislation movement to contribute to creating an efficient and safe legal environment capable of attracting investment and employing it to achieve the public interest of the country.
